Navigating Divorce and Real Estate in Nevada County

Divorce is hard enough without adding a house to the mix.

As a Realtor serving Nevada County, one of the questions I hear most often is, "What do we do with the house?" For many couples, the family home is their largest asset. It's also the place where memories were made, children were raised, and life happened. That can make decisions about real estate feel emotional, overwhelming, and sometimes impossible.

Keeping or selling can be a tough choice. Sometimes it absolutely makes sense to keep the home. For example, if you want to provide stability until a child graduates from high school. Other times, the desire to keep the house is tied to something less practical: holding onto the dream of "happily ever after" by simply changing its form.

The good news is that you don't have to figure it out alone.

I'm a Real Estate Collaboration Specialist–Divorce (RCS-D), a designation focused on helping divorcing homeowners navigate the real estate side of separation with clarity and professionalism. My role is not to provide legal advice. Instead, I help clients understand their real estate options, avoid common pitfalls, and make informed decisions during a time when emotions are often running high.

In Nevada County, every situation is different. A couple in a historic home in Nevada City may face different challenges than a family living on acreage in Grass Valley or Alta Sierra. Market conditions, mortgage rates, equity, tax implications, and future housing plans all play a role in determining the best path forward.

Generally, divorcing homeowners have three options:

Sell the home and divide the proceeds.

This is often the cleanest solution. Selling allows both parties to access their equity and move forward independently. In today's Nevada County market, understanding property value, market timing, and net proceeds is critical to maximizing the outcome.

One spouse keeps the home.

This option can provide stability, especially when children are involved. However, keeping the house is often more complicated than people realize. A buyout, a refinance, a new interest rate, future maintenance costs, insurance, taxes, and long-term affordability all need to be carefully evaluated.

Continue co-owning temporarily.

In some situations, couples choose to retain ownership together (essentially as business partners) for a period of time. This may allow children to remain in the home or provide flexibility while larger financial decisions are being made. Clear agreements and professional guidance become especially important in these cases.

One of the biggest mistakes I see is waiting too long to bring a real estate professional into the conversation. By the time a settlement agreement is being finalized, decisions about value, equity, market timing, and housing options often should have already been discussed.
